Preamble

These Terms of Service (hereinafter "ToS") govern access to and use of the HollyFriends mobile application (hereinafter "the Application") published by Gerlando Zicari, as well as all associated services.

Use of the Application implies full and unreserved acceptance of these ToS. If you do not accept them, you must refrain from using the Application.

Article 1 — Definitions

Application: the HollyFriends mobile software available on iOS and Android.
User: any natural person registered and using the Application.
Account: the personal space created by the User.
Content: any text, photo, vibe, message, establishment proposal, or other element published by a User.
Establishment: a hotel, hostel, campsite or guest house listed in the Application.
Hub: a temporary discussion room associated with an Establishment.

Article 2 — Purpose of the Application

HollyFriends is a social network for young travellers that allows users to:

Indicate their presence ("check-in") at a tourist accommodation
Chat in real time with other travellers at the same accommodation (hubs)
Discover active establishments nearby (proximity radar)
Rate the social atmosphere of establishments (vibe scores)
Browse and participate in rankings
Propose the addition of new establishments

The Application offers neither booking services nor commercial transactions. It acts solely as a social intermediary.

Article 3 — Registration and Account

3.1 Registration Requirements

Registration is open to any natural person who is:

at least 13 years of age, and, for minors under 15, has obtained the express consent of a holder of parental authority (Article 8 GDPR; Article 45 of the French Data Protection Act as amended);
in possession of a valid email address;
in agreement with these ToS and the Privacy Policy.

The User undertakes to provide accurate information upon registration, including their actual year of birth.

3.2 Minors

Minor Users (under 18 years old) declare and warrant that they have obtained prior authorisation from a holder of parental authority to use the Application. For minors under 15, this authorisation is mandatory for account creation; it is collected by declaration at registration and may be verified at any time.

Gerlando Zicari reserves the right to suspend any minor's account for which parental authorisation cannot be demonstrated.

3.3 Confidentiality of Credentials

The User is solely responsible for the confidentiality of their credentials and for any actions carried out from their Account. Any fraudulent use must be reported without delay to legal@hollyfriends.com.

3.4 Single Account

Each User may hold only one Account. Creating multiple accounts is prohibited.

Article 4 — Rules of Use and Prohibited Content

The User undertakes to use the Application in compliance with the law, public morality and these ToS.

4.1 The Following Are Strictly Prohibited

Any content of a hateful, racist, sexist, homophobic, transphobic or discriminatory nature;
Any pornographic, sexually explicit or child abuse content;
Any content glorifying terrorism, violence or illegal behaviour;
Harassment, threats or insults directed at other Users;
Impersonation of third parties;
Disclosure of third-party personal data without their explicit consent;
Any advertising, commercial solicitation, spam or unauthorised promotional content;
Use of the Application for sexual encounters or grooming of minors;
Any attempt at unauthorised access to, alteration of, or disruption of the Application;
Use of bots, scripts, scrapers or any other unauthorised automated means.

4.2 Declarative Check-ins

Check-ins are declarative: the User declares on their honour that they are actually present or intend to be at the stated establishment on the stated dates. Repeated false declarations may result in account suspension.

4.3 Photos and Avatars

The User only publishes photos of which they are the author or for which they hold the necessary rights. Photos must comply with the rules of Article 4.1.

Article 5 — Moderation

5.1 Reporting

Any User may report manifestly unlawful content via the tools provided in the Application or by email to legal@hollyfriends.com.

5.2 Publisher Obligations

Gerlando Zicari promptly removes any manifestly unlawful content brought to its attention or makes access to it impossible.

5.3 Sanctions

In the event of a breach of these ToS, Gerlando Zicari reserves the right, without prior notice or compensation, to:

remove the disputed content;
warn the User;
temporarily suspend the Account;
permanently terminate the Account;
report unlawful content to the competent authorities.

Article 6 — Intellectual Property

6.1 Application and Publisher Content

The Application, its source code, visual identity, logos, trademarks, and all content produced by Gerlando Zicari are protected by intellectual property law. Any unauthorised reproduction, representation or exploitation is prohibited.

6.2 User Content

The User remains the owner of the Content they publish (photos, messages, vibes, proposals).

By publishing Content on the Application, the User grants Gerlando Zicari, free of charge, non-exclusively, and for the legal term of copyright protection, a licence to:

reproduce, host, store and back up the Content;
display, broadcast and make it accessible to other Users within the Application;
technically adapt it (formats, resolutions, thumbnails) for the needs of the Application.

The User warrants that they hold the necessary rights to the Content they publish and indemnifies Gerlando Zicari against any third-party claims in this regard.

The User may delete their Content from the Application at any time. Account deletion results in the deletion of all the User's Content within a maximum of 30 days, with the exception of backup copies and already shared/quoted content, which may persist until expiry of the backup cycle (maximum 90 days).

6.3 External Data

Establishment data is sourced from the Atout France register (open data) and OpenStreetMap (ODbL licence — © OpenStreetMap contributors). The User undertakes to respect these licences in any reuse.

Article 7 — Establishment Proposals

The User may propose the addition of a new establishment. The proposal is processed automatically by an agent that supplements missing information from public sources (Nominatim, official establishment websites).

The User acknowledges:

not being remunerated for their proposals;
accepting that Gerlando Zicari remains the sole judge of whether an establishment is published;
not proposing fictitious or misleading establishments.

Article 8 — Geolocation

The Application requests access to location in the foreground only, for the purposes of the proximity radar. Location data is not stored on servers and is processed locally on the device.

The User may revoke access to location at any time in their device settings. Such refusal will, however, render certain features unusable (proximity radar).

Article 9 — Notifications

The User may enable/disable push notifications at any time from their profile or device settings. No commercial notifications are sent without prior explicit consent.

Article 10 — Liability

10.1 Availability

Gerlando Zicari endeavours to ensure that the Application is available 24/7, without being bound by an obligation of result. The Application may be unavailable for maintenance, updates or force majeure.

10.2 Content

Gerlando Zicari acts as a host within the meaning of Article 6 of the French LCEN with respect to Content published by Users. Gerlando Zicari is not subject to a general obligation of surveillance.

Gerlando Zicari cannot be held liable for Content published by Users, nor for relationships formed between Users through the Application.

10.3 Physical Meetings

The Application facilitates connections between travellers but does not organise physical meetings. The User is solely responsible for their own safety during any in-person meetings with other Users, and is strongly advised to exercise caution, especially if they are a minor.

10.4 Establishment Data

Information about establishments (addresses, photos, facilities) is provided for informational purposes and may contain errors or be out of date. Gerlando Zicari cannot be held liable for its accuracy.

Article 11 — Personal Data

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these ToS.

Article 12 — Termination

12.1 By the User

The User may delete their Account at any time, without reason, from the Profile screen of the Application.

12.2 By the Publisher

Gerlando Zicari may suspend or terminate a User's Account in the event of:

breach of these ToS;
behaviour harmful to other Users or the Application;
a request from a competent judicial or administrative authority.

Article 13 — Amendments to the ToS

Gerlando Zicari reserves the right to amend the ToS at any time. Users are informed of material changes by notification within the Application and must accept the new version to continue using the Application.

The date of last update appears at the head of this document.

Article 14 — Future Business Model

The Application is currently offered free of charge. Gerlando Zicari reserves the right to introduce in the future premium features, subscriptions or paid options.

Any price change will be notified within the Application with a minimum notice of 30 days before it takes effect. The User may refuse the change by deleting their Account.

Access to existing free features may not be made conditional on payment without the User's express renewed acceptance of the pricing terms.

Article 15 — Governing Law and Jurisdiction

These ToS are governed by French law.

In the event of a dispute, and after attempting amicable resolution (see Legal Notice — Mediation), only French courts shall have jurisdiction.

For consumer Users, the jurisdictional rules provided by the Consumer Code apply.
